NY attorney general sues Dell, claiming deceptive practices

NEW YORK -- New York Attorney General Andrew Cuomo on Wednesday accused Dell Inc. and its financial services affiliate of "bait and switch" advertising practices and failing to deliver on promised customer service.

Cuomo announced details of a lawsuit filed a day earlier in state Supreme Court in Albany County, claiming that Dell and Dell Financial Services LP engaged in fraud, false advertising and deceptive business practices.

The lawsuit accuses Round Rock, Texas-based Dell of luring customers with zero percent financing but, at the time of purchase, tricking them into higher interest rates, often without their knowledge.

Dell spokesman Bob Pearson said in a written statement that the company's conduct has been honorable.

"Our customers are our top priority at Dell," Pearson said. "We will vigorously defend ourselves in court. We are confident that our practices will be found to be fair and appropriate. While even one dissatisfied customer is too many, the allegations in the AG's filing are based upon a small fraction of Dell's consumer transactions in New York."

Cuomo told a news conference that his office had "received an unprecedented number of complaints against Dell, approximately 700 and they keep coming."

"We want fairness," said Cuomo. "Either provide the customer service packages that you sell or don't sell the packages."

While Dell frequently advertises zero percent financing plans for computer purchases, the attorney general said that as many of 85 percent of those who applied did not receive that rate.

The lawsuit also claims that Dell sold onsite computer repair plans but failed to deliver, at times requiring customers to disassemble their own computers.

The lawsuit seeks an order requiring Dell to pay unspecified damages to affected customers, a $500 payment to the state for each instance of some violations, and another $2,000 for additional costs.

In an unrelated probe, the Securities and Exchange Commission and Dell's own audit committee have been investigating the company's accounting practices.

In recent months, Dell has seen a management shakeup that included the departure of several top executives _ including Chief Executive Officer Kevin Rollins and Chief Financial Officer Jim Schneider _ and the return of Michael Dell as CEO.

With Dell at the helm, the company has been trying to orchestrate a turnaround plan to improve customer service and combat Hewlett-Packard Co. and other electronics manufacturers who have eaten into Dell's market share with low-cost, low-profit PCs.


Before you buy a HP…
• HP customizes thier motherboards.
  • HP has their motherboards built to their specks.
  • When changing the operating systems you will encounter an error with the hardware, Multimedia Audio Controller, can't find driver for it.
  • This problem occurrs with the early HP computers and I just formatted a new HP that came with Vista and installed HP Pro SP2 and had the same problem.
  • Using Windows Updates or checking the web for drivers for this controller will end up with you wasting your time.
  • I just spent a week going back and forth with HP concerning this problem with them telling me to update the modem drivers, use windows updates and last but not least contact MS Support and we all know where that leads.
  • My suggestion is if you ever plan on changing Operating Systems on a HP box is be prepared to contend with this problem or buy another brand
  • So if you don't want to deal with the Multimedia Audio Controller errors I suggest you check with the support for the manufacture you are considering to see what problems can or will occur.
  • Gateway has great support and will work with you to solve all problems. HP and Dell will not, they just pass the buck and waste your time.
  • On the last two HP boxes I've changed the system on I've had this problem with the Multimedia Audio Controller.
